THE ISSUES

  • Child sex traffickers are increasingly targeting and recruiting youth directly from foster care, group homes, and residential placements, exploiting the vulnerability of those without stable home environments.
  • Family defense attorneys often serve the interests of courts and removing agencies rather than their clients, making the separation of powers appear illusory. Social workers frequently falsify their reports and commit perjury in court without facing accountability.
  • The agency infringes on parents' constitutional rights and retaliates against them for speaking out about injustices in their cases. 
  • Social workers fail to make reasonable efforts to keep families together and to provide the necessary services for reunification in a timely manner, as required by law pursuant to Title IV-E.
  • Child welfare practices and procedures are governed by arbitrary guidelines and nearly limitless judicial discretion.

  • Domestic violence victims are unfairly criminalized by child welfare services. Children are often removed from parental custody due to mandatory reporting laws, which require domestic violence service providers to lodge child abuse hotline referrals for victims with children. Under California law, children can be removed if an abused parent is perceived as unable to safeguard their children's safety, but the language is vague and gives far too much latitude to social workers.
  • Mental health is unfairly weaponized against parents to facilitate the removal and adoption of children, even in cases where no harm has come to the children.

OUR DEMANDS

  • We demand that San Diego CWS/CPS hold its social workers fully accountable for any misconduct. Should this demand not be met, we insist on the resignation or removal of Kimberly Giardina, CWS/CPS director.
  • We demand grandparent and sibling rights, increased and higher quality visitation, and kinship placement. Should this demand not be met, we insist on the resignation or removal of Kimberly Giardina, CWS/CPS director.
  • We demand our constitutional rights and fairness and justice in court proceedings. Should this demand not be met, we will insist on the removals of San Diego Superior Court judges from office.
  • We demand effective assistance of counsel. Parents have the right to due process and to respond to the allegations against them. Children have the right to be heard in their own proceedings. Family defense attorneys must develop legal defense strategies and introduce exculpatory evidence when relevant. Should this demand not be met, we will insist on the revocation of attorney licenses.
